Privacy Policy
This policy explains what personal information we collect, why we collect it, who we share it with, and the choices and rights you have.
Last updated: September 19, 2026
Digital Incorporates LLC (“Digital Incorporates”, “we”, “us”) operates https://digitalincorporates.com and provides digital marketing services. We are committed to handling personal information lawfully, transparently and securely.
1. Information we collect
Information you give us. When you submit a form, subscribe to our newsletter, create a client account or email us, we collect your name, email address, telephone number, company name, website, budget range, timeline and the contents of your message.
Information collected automatically. When you visit the site we and our analytics providers may collect your IP address, browser type and version, device type, operating system, referring URL, pages viewed, time on page and approximate location derived from IP. This is collected through cookies and similar technologies as described in our Cookie Policy.
Client account information. If you hold an account in our client portal we store your name, email, hashed password, company, telephone number and project records.
We do not knowingly collect sensitive personal information, and we do not knowingly collect personal information from anyone under 16 years of age.
2. How we use your information
- To respond to enquiries, prepare audits and proposals, and provide the services you engage us for.
- To create and manage your client portal account and communicate about your projects.
- To send marketing emails where you have opted in, which you can stop at any time.
- To analyse site usage, measure marketing performance and improve our content and services.
- To detect, prevent and address fraud, abuse, security incidents and technical problems.
- To comply with legal obligations and to establish, exercise or defend legal claims.
3. Legal bases (for individuals in the EEA and UK)
Where GDPR applies, we rely on: your consent (marketing cookies and email marketing); performance of a contract (delivering services you have engaged); our legitimate interests (running, securing and improving our business, and responding to business enquiries); and compliance with legal obligations.
4. How we share information
We do not sell your personal information. We share it only with:
- Service providers who process data on our behalf — web hosting, email delivery, analytics, CRM and advertising platforms — under contracts that restrict their use of the data.
- Advertising and analytics partners such as Google and Meta, where you have consented to those cookies. These parties may act as independent controllers of the data they collect.
- Professional advisers such as accountants and lawyers, where necessary.
- Authorities, where required by law, subpoena or a similar legal process, or to protect rights and safety.
- A successor entity in the event of a merger, acquisition or sale of assets, subject to this policy.
5. Cookies and tracking
We use necessary cookies to operate the site and, with your consent, analytics and advertising cookies. You can accept or reject non-essential cookies through the banner shown on your first visit and change your choice at any time by clearing your browser storage for this site. See the Cookie Policy for detail.
We honour Global Privacy Control (GPC) signals where our systems detect them.
6. Data retention
We keep enquiry records for up to 36 months from your last interaction, client records for the duration of the engagement plus seven years where required for tax and legal purposes, and newsletter subscriptions until you unsubscribe. Analytics data is retained per the provider's configured retention window, typically 14 months.
7. Your privacy rights
US residents. Depending on your state of residence — including California (CCPA/CPRA), Virginia, Colorado, Connecticut, Utah, Texas and other states with comprehensive privacy laws — you may have the right to know what personal information we hold, to access a copy, to correct inaccuracies, to request deletion, to opt out of targeted advertising or any “sale” or “sharing” of personal information, and not to be discriminated against for exercising these rights.
We do not sell personal information and we do not share it for cross-context behavioural advertising except through the advertising cookies you consent to, which you may reject at any time.
EEA/UK residents additionally have rights to restriction, portability, objection and to lodge a complaint with a supervisory authority.
To exercise any right, email hello@digitalincorporates.com with the subject “Privacy Request”. We will verify your identity and respond within 45 days (extendable once by a further 45 days where permitted). An authorised agent may submit a request on your behalf with written proof of authorisation.
8. Email and SMS communications
Marketing emails include an unsubscribe link in every message and are sent in accordance with the CAN-SPAM Act. Where we send SMS, we do so only with prior express written consent as required by the TCPA; message and data rates may apply and you can reply STOP to opt out at any time.
9. Security
We use HTTPS across the site, hash all account passwords, restrict administrative access to named individuals, and apply CSRF protection and input validation on all forms. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you and the relevant authorities as required by law.
10. International transfers
We are based in the United States and our service providers may process data in the US and other countries. Where personal information is transferred from the EEA or UK, we rely on Standard Contractual Clauses or another lawful transfer mechanism.
11. Third-party links
Our site links to third-party websites and platforms. We are not responsible for their content or privacy practices, and we encourage you to read their policies.
